The privacy of your personal data is one of the main concerns for SC SARMANSANCA TRANS SRL, with its headquarters in Targu Mures, B-dul 1 Decembrie 1918, Nr.297, as data operator.

II.1. If you are a Customer of the website,

SC SARMANSANCA TRANS SRL will process your personal data such as name, phone, e-mail, billing address, delivery address, information about how you use the website, for example your behavior/ preferences/ habits in the SC SARMANSANCA TRANS SRL, as well as any other categories of information you provide directly by creating your user account, by placing an order on the website or by means of any other use of the website.

If you use your Facebook or Google account in order to create a user account on the website, SC SARMANSANCA TRANS SRL will process the following public profile data displayed by the respective applications: username, email address.

The website will not allow accounts to be created and will not retain any data regarding this.

  • to handle the contractual relationship between you and SC SARMANSANCA TRANS SRL, respectively to take, validate, send and invoice the orders placed on the website, to inform you of the order status, to organize the return of ordered products etc.

    Scope: Processing your data for this purpose is done based on the contract between you and SC SARMANSANCA TRANS SRL, as defined in the Terms and Conditions. Your personal data has to be provided for the performance of this contract. Refusing to provide this data may result in the impossibility to handle the contractual relation between you and SC SARMANSANCA TRANS SRL.

Providing your data for this purpose is optional. Refusing to provide data for this purpose will not have negative consequences for you.

III.2. If you are a visitor of the website, 

SC SARMANSANCA TRANS SRL will process your personal data as follows:

  • marketing activities, i.e. transmitting, by means of distance communication (email, sms) commercial notifications related to the products and services offered by SC SARMANSANCA TRANS SRL through the website.

IV. The period of time your data is being kept for

As a principle, SC SARMANSANCA TRANS SRL will process your personal data as long as it is necessary in order to achieve the above mentioned processing purposes.

If you are a customer, we will process your data for the duration of the contractual relationship and afterwards as per the legal obligations of SC SARMANSANCA TRANS SRL (for example, the financial accounting documents must be kept for 10 years from the date of the financial year in which they were issued).

If you are customer and exercise your right to delete your account by email at office@hotelsandoria.ro, SC SARMANSANCA TRANS SRL will interpret this action as your option to unsubscribe from receiving commercial communications which we use in order to keep you informed about the
products and services offered through the website. In this respect, if you choose to delete your user account, we will no longer send you emails and / or sms of this kind. However, we hereby inform you that deleting your account will not automatically erase your personal data.

If you do not want your personal data to be processed or you want to delete the data, you can exercise the rights detailed in Section VII below. If you request the deletion of the account, but there is at least one active request, the account deletion request will only be processed after the delivery of the products and the completion of the last active order.

If you withdraw your consent to data processing for marketing purposes, SC SARMANSANCA TRANS SRL will cease to process your personal data for that purpose, but the data processed by SC SARMANSANCA TRANS SRL based on your prior consent shall not be affected.

 

V. Disclosure of personal data

For the purposes of data processing, SC SARMANSANCA TRANS SRL may disclose your data to partners, third parties or entities that support SC SARMANSANCA TRANS SRL in the activity through the website (e.g. courier companies, IT service providers), or to the central / local public authorities, in the following cases:

  • for the administration of the website;
  • in situations where such communication would be necessary in order to award prizes or other perks to the individuals concerned as a result of
    their participation in various promotional campaigns organized by SC SARMANSANCA TRANS SRL through the website;

Personal data provided to SC SARMANSANCA TRANS SRL will not be transferred outside of Romania.

Under the conditions set out in the legislation on the processing of personal data, you are entitled to the following rights:

  • the right to information, i.e. the right to receive details of the processing activities carried out by SC SARMANSANCA TRANS SRL, as described
    in this document; 

  • the right of access to data, i.e. the right to obtain confirmation from SC SARMANSANCA TRANS SRL regarding the processing of personal data,
    as well as details of processing activities such as the way the data is being processed, the purpose of the processing, the recipients or categories of
    data recipients, etc.;

  • the right to rectification, i.e. the right to obtain the correction, without delay, by SC SARMANSANCA TRANS SRL of any inaccurate or unjustified personal data, as well as the right to complement incomplete data; The rectification / completion shall be communicated to each recipient to whom the data was transmitted, unless this proves impossible or involves disproportionate efforts.

  • the right to delete the data without undue delay (‘the right to be forgotten’) in case one of the following situations applies:
    – they are no longer necessary for the purposes for which they were collected or processed;
    – if consent is withdrawn and there is no other legal basis for processing;
    – if the subject opposes to data processing and there are no legitimate reasons to prevail;
    – if personal data has been processed unlawfully;
    – if personal data has to be deleted for compliance with a legal obligation;
    – personal data has been collected for the scope of providing IT services in accordance with the EU or national regulations applicable where the
    operator is located. It is possible that, following the request to delete the data, SC SARMANSANCA TRANS SRL renders anonymous these data (thus depriving them of personal character) and continues processing it for statistical purposes under these conditions;

  • the right to restrict the processing to the extent that:
    – the person challenges the accuracy of the data for a period that allows us to verify the correctness of the data;
    – processing is illegal and the holder of the data is against the deletion of personal data, but asks for restrictions on their use;
    – the operator no longer requires personal data for processing, but the data holder requests them in order to find, exercise or defend a right in
    court; or 
    – the data holder opposed to data processing (other than for direct marketing) for the period during which it is verified that the operator’s
    legitimate rights prevail over those of the data holder. 

  • the right to data portability, respectively (i) the right to receive personal data in a structured way, commonly used in an easy-to-read format,
    and (ii) the right to have such data transmitted by SC SARMANSANCA TRANS SRL to another data controller, to the extent that the conditions provided by law are met;

  • the right to object – regarding the processing activities, this right may be exercised by submitting a request as indicated below;

  • at any time, for reasons related to the particular situation of the data holder, the latter has the right to object to data processing based on the
    legitimate interest of SC SARMANSANCA TRANS SRL or for the public interest, except in cases where SC SARMANSANCA TRANS SRL can

  • the right not to be subject to an automatic individual decision, that is to say, the right not to be the subject to a decision taken solely based
    on the automatic processing, including profiling, which produces legal effects concerning the data holder or significantly affects them;

  • the right to address to the National Supervisory Authority for Personal Data Processing or the competent legal courts, to the extent that you
    deem it necessary.
